O R D E R

% 24.03.2026 1.

Applicant seeks regular bail in FIR No.624/2020 dated 27.12.2020, registered at PS Mayur Vihar, Phase-1, for commission of offences under Sections 302/307/34 IPC and Sections 25/27 of Arms Act, 1959. Subsequently, in the charge-sheet offences under Sections 147/148/149/120B IPC were added.

The abovesaid session trial pertains to a case where one person lost his life and several others received injuries. The accused party was, reportedly, armed with firearms and multiple such injuries are on account of gunshots. 3.

Learned counsel for the applicant submits that only 13 witnesses have been examined, so far and trial is going on at a slow pace and, moreover, one similarly situated co-accused i.e. Salman has already been enlarged on bail by Coordinate Bench of this Court vide order dated 04.01.2024 in BAIL APPLN.4029/2023.

Learned Addl. P.P. for the State appears on advance notice and is duly assisted by the concerned Investigating Officer. It is informed that few injured persons are still to be examined.

Indubitably, the matter has already been delayed considerably and the incarceration period is, virtually, at the verge of five years. 6.

However, after hearing arguments for some time, learned counsel for the applicant, without prejudice to his rights and contentions, seeks to withdraw the present bail application with liberty to file bail application afresh after examination of remaining injured persons. 7.

Learned Addl. P.P. for the State also assures that every effort would be made to procure the attendance of the remaining injured persons and to get their testimony recorded without any further delay. 8.

Let the abovesaid exercise be carried out within the period of three months from the date the learned Trial Court takes up the matter. 9.

The application is, accordingly, disposed of in aforesaid terms. 10.

Liberty, as prayed, is granted.

It is also clarified that in case prosecution fails to examine all the injured persons within the abovesaid time period of three months, the applicant herein would be at liberty to file fresh application before this Court. 12.

All rights and contentions of the parties are reserved. 13.

Pending applications also stand disposed of.
