The instant petition has been filed on behalf of the petitioner under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking issuance of a writ in the nature of habeas corpus for the production of the petitoner's wife i.e. respondent No.4 herein.

In pursuance of order dated 4th March, 2025, respondent No.4/Ms. Yogita has appeared before this Court and submitted that she wants to live with her parents and also apprised the Court that she has already filed a divorce petition before the Ghaziabad Court, Uttar Pradesh. 3.

prayed that the instant matter be sent to the Mediation Centre for an amicable settlement between the parties.

On the specific query made by this Court, respondent No.4/Ms. Yogita, appearing in-person, objected to the prayer of reference to the Mediation Centre and expressed her intention to pursue the divorce petition filed in Ghaziabad Court, Uttar Pradesh.

Considering that the respondent no. 4/Ms. Yogita has appeared before this Court, and in light of the foregoing facts and circumstances, this Court is of the view that there is nothing left for further adjudication of the instant petition.

Accordingly, the instant petition stands disposed of.
