The present writ petition has been filed seeking the following reliefs: "a) Issue an appropriate writ, order or direction in the nature of mandamus directing Respondent No. 1 to forthwith take appropriate action under law to stop and demolish the unauthorized and illegal construction being carried out by Respondent No. 3 at property bearing No. G-63, Lajpat Nagar-I, New Delhi-110024; b) Issue an appropriate writ, order or direction restraining Respondent No. 3, his agents, employees or any person acting on his behalf from carrying out any further construction or alteration The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

whatsoever on the terrace or any portion of the said property in violation of municipal or leasehold norms;

c) Direct Respondent Nos. 1 to inspect the said premises and take all necessary steps to ensure removal of the illegal encroachment over the common staircase and unauthorized structures constructed on the rooftop, and restore access to common areas to the Petitioners and other lawful occupants"

The grievance of the petitioners is that the respondent no.3 is carrying out illegal and unauthorized construction at the subject property, i.e., property no. G-63, Lajpat Nagar-I, New Delhi-110024 in violation of the municipal bye-laws as well as structural safety norms. 4.

A complaint has been filed by the petitioners with the respondent no.1/ MCD.

It is stated that the petitioners reside on the first and second floors of the subject property, whereas the respondent no.3 resides on the third floor. Photographs of the ongoing construction have been filed along with the present petition.

Counsel appearing on behalf of the respondent no.1/ MCD submits that the subject property has been inspected and it has been found that unauthorized construction is being carried out on the terrace of the third floor of the subject property. Accordingly, a show cause notice as well as a work stop notice dated 17th March, 2026 has been issued to stop further unauthorized construction.

The petitioners also contend that the respondent no.3 has encroached upon the common staircase leading from the third floor to the terrace of the subject property.

In the event, the petitioners have any further grievance with regard to unauthorised construction, they are at liberty to take appropriate remedies in accordance with law.
