By the impugned order dated 25.02.2026, interim bail sought by the applicant on medical grounds was refused by the learned Sessions Court, holding that the appellant's surgery had already been fixed at the Civil Hospital, Gurugram, on 26.02.2026.

Mr. Siddharth Yadav, learned counsel for the appellant, states that surgery was not conducted on 26.02.2026 and as far as the appellant is aware, no new date of surgery has been fixed. 3.

In view of the aforesaid change of circumstances, Mr. Yadav seeks permission to withdraw this appeal with liberty to approach the learned Sessions Court afresh.

The appeal, alongwith the pending application, is dismissed as withdrawn with liberty as aforesaid.
