CORAM:
HON'BLE MR. JUSTICE RAJIV SHAKDHER
O R D E R
% 19.02.2020 1.
The substantive prayers made in this writ petition are as follows : "(a) Issue an appropriate writ[s]/direction[s] or order[s] quashing the WRC's order dated 01.08.2019; and (b) Issue an appropriate writ[s]/direction[s] or order[s] directing the WRC for reconsidering the case of the Petitioner institution and passing the appropriate orders." 2.
This writ petition came up for hearing on 04.02.2020 when the main grievance of the petitioner was recorded. Ms. Arunima Dwivedi was present on that date on behalf of the respondents. Ms. Dwivedi, accordingly, was granted time to obtain instructions in the matter. W.P.(C) 1290/2020
3.
It was made clear that if the instructions were received to resist the writ petition, a counter affidavit will be filed before today. 4.
No counter affidavit has been filed. I have queried Ms. Dwivedi, dehors anything else, as to whether the petitioner's case was considered in the 255th and 268th meetings of the Western Regional Committee (WRC). 5.
Ms. Dwivedi says that the record does not disclose that the petitioner's case was considered at the aforementioned meeting of the WRC. 6.
In these circumstances, the impugned order is unsustainable in law. 7.
Accordingly, the impugned order dated 01.08.2019, passed by the WRC is set aside.
8.
The WRC will reconsider the petitioner's application for commencing the B.Ed. course.
9.
Needless to add, the aforesaid exercise will be carried out by the WRC with due expedition.
10.
The captioned writ petition is disposed of in the aforesaid terms. The pending application shall stand closed.
