By way of instant application the petitioner is seeking anticipatory bail in FIR bearing No. 0189/2024, registered at Police Station Vasant Vihar, for the offences punishable under Section 110 of the Bhartiya Nagrika Suraksha Sanhita, 2023.

Issue notice. Mr. Naresh Kumar Chahar, learned APP accepts notice on behalf of the State.

The brief facts, as discernible from the material on record are that the complainant had alleged that on 15.12.2024, at approximately 3:00 PM, while taking a bath, she had heard a scream from her daughter, Lakshita, she had immediately rushed to the first floor of her house where she had rung The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The complainant had screamed for help and attempted to defend herself, but the applicant had attacked her with a screw driver, threatening to kill her. He had attacked her multiple times with the screw driver, causing injuries to her left thigh and left elbow. Furthermore, he had picked up a knife with the intent to kill her. She had pushed him away and had managed to flee inside the house, locking the door behind her. The complainant had alleged that had she not escaped, her husband would have killed her. Subsequently, she had called the police, who had arrived at the scene and taken her to the hospital, where she had received treatment. Upon reaching the hospital, the complainant had given a written statement and on 16.12.2024 at approximately 9:45 PM had lodged her formal complaint against the applicant.

The learned counsel appearing on behalf of the petitioner states that the petitioner herein has falsely been implicated in this case and further states that the petitioner and the complainant have entered into a comprehensive agreement vide MoU dated 11.02.2025. 5.

The complainant is also present before this Court and states that she has entered into a settlement with the present accused as well his mother and sister.

The complainant further states that since a comprehensive agreement has been entered into between the parties, in case, the petitioner herein is not granted bail, the conditions of the MoU will be fructified. 7.

Keeping in view all the facts and circumstances mentioned hereinabove, this Court is inclined to grant anticipatory bail to the petitioner The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

on his furnishing personal bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the SHO/I.O concerned on the following terms and conditions:

i) The applicant shall remain available on mobile numbers; shared by him with the Police.

ii) The applicant shall not leave the country without prior permission of the concerned IO/SHO.

iii) The applicant shall not directly or indirectly make an attempt to influence the witnesses or tamper with the evidence in any manner.

iv) In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned I.O/SHO.

The bail application stands disposed of.

However, in case the petitioner or the other parties who are party to the MoU do not comply with the conditions of MoU, it will be a ground for cancellation of anticipatory bail.
