The petitioner/ wife is seeking initiation of contempt proceedings against the respondent/ husband for wilful breach and disobedience of the order dated 3rd May, 2023 passed in HMA No. 1414/2023 by the Family Court-02, South-West, Dwarka, New Delhi.

The grievance of the petitioner/ wife is that the respondent/ husband, in violation of his undertaking recorded in the Memorandum of Understanding (MoU) dated 20th November, 2022, has instituted a petition under Section 25 of the Guardians and Wards Act, 1890, before the Principal Judge, Family Court, Gautam Budh Nagar, Uttar Pradesh.

Holding the respondent/ husband prima facie guilty of committing wilful disobedience of the directions of this Court and the aforesaid undertaking, notice was issued to the respondent on 11th March, 2025. Counsel appears on behalf of the respondent/ husband and tenders an unconditional apology on behalf of the respondent. 5.

Counsel for the petitioner submits that the respondent may be directed to place a written apology on record.

I am in agreement with the aforesaid submission. 7.

Let an unconditional written apology be filed on behalf of the respondent/ husband within two (2) days with a copy to counsel for the petitioner.

In view of the above, the contempt proceedings shall stand purged. 9.
