The respondent-MCD, in terms of paragraph no.5 of the Status Report dated 02.08.2024, has taken the following position:- "That it is pertinent to mention here, that the permission for extension of time for installation of lift in the present matter was sought by owners of flat No. 248, 250, 251, 252, 253, Plot No 8, Farmers Cooperative Group Housing Society Limited, Sector-13, Rohini, Delhi110085 which has been granted by the MCD after following due process of law, after obtaining the approval of the Competent Authority for a further period of six months w.e.f 09.08.2024 vide letter No. AE(B)-IV/RZ-V2024/288 dated 31.07.2024 Copy of the same is annexed as ANNEXURE-A. The said extension of time has been granted on the laid down guidelines / terms of policy conta1ned in the letter No. AE(B)-/RZI2019/1255 dated 09.08.2019.

order which was earlier operating against the respondent. 3.

The aforesaid order was passed keeping in mind the averments made by the respondent-MCD in its counter-affidavit where an unequivocal stand was taken by the respondent-MCD that the lift in question was installed in accordance with the applicable rules and regulations. 4.

So far as the grievance with respect to the expiry of the validity of the period within which the lift was to be installed is concerned, the same stood extended, as has been stated in paragraph no.5 of the status report. Therefore, the Court does not find it appropriate to keep the instant writ petition pending and the same stands disposed of alongwith the pending applications.
