O R D E R

% 09.01.2020 An award of compensation of Rs.4,73,683/- alongwith interest @ 9% per annum from the date of filing of the claim i.e. 07.01.2004 till its realization was passed on 13.10.2008.

The appellant has already paid Rs. 4,50,000/-. Rs.50,000/- was paid as interim award, therefore, no interest on the said amount was to be paid. Rs. 4,00,000/- was paid in January, 2009, almost 11 years ago and the remaining amount of Rs.23,683/- is to be paid. The appellant's son- Mr. Mayank Jain is present in the Court and offers to pay an equal amount. In the circumstance, let Rs.45,000/- be paid to respondent no.2 towards the settlement of the claim amount.

At this stage, Mr. Mayank Jain has handed over a cheque bearing

no.001346 dated 09.01.2020 for a sum of Rs.45,000/- drawn on ICICI Bank, Delhi Hargovind Enclave, 132, Hargovind Enclave, New Delhi-110092, to the learned counsel for respondent no. 2 who has accepted it in full and final settlement of the claim satisfaction and of the compensation amount. He submits that the cheque is good for encashment. Identity proof of Mr. Mayank Jain is taken on record. The appeal is disposed-off in the above terms. The statutory amount, alongwith interest accrued thereon, be returned to the appellant.

A copy of this order be given dasti to the learned counsel for the parties.
