Petitioners herein have been held guilty for commission of offence under Section 138 of Negotiable Instruments Act, 1881 and have been sentenced to undergo SI for a period of six months and have also been burdened with fine of Rs.2,21,74,000/-.

They challenged the abovesaid conviction and order on sentence by filing an appeal i.e. CRL.A. 323/2024 and when such appeal was taken up by learned Appellate Court on 14.10.2024, while suspending the sentence of the petitioners, it also directed them to deposit 20% of the fine amount by next date of hearing i.e. 04.02.2025.

Such order is under challenge.

The present petition is pending for quite some time and when asked, learned counsel for the petitioners submitted that since the amount is very high, it was not possible for the petitioners to arrange the amount and to CRL.M.C. 1563/2025 1 Signed By:SONIA THAPLIYAL 16:06:34
deposit the same at such a short notice. He also submits that there is aspect of part payment which has, somehow, not been considered appropriately by the learned Trial Court.

During the course of the arguments, learned counsel for the petitioners, without prejudice to their rights and contentions, undertake to deposit the abovesaid 20% amount with the learned Appellate Court on or before 29.08.2026.

Keeping in mind the overall facts of the case, the abovesaid limited request is acceded to and the petition is disposed of with direction to petitioners to deposit the abovesaid amount in terms of impugned order dated 14.10.2024 on or before 29.08.2026.

The petition is disposed of in aforesaid terms. 8.
Pending application also stands disposed of.

A copy of this order be sent to learned Appellate Court and to learned Trial Court for information.
