% 07.03.2025 1.

Counsel for defendants no.1 and 2 submits that he does not wish to file reply to the I.A. 45104/2024 seeking summary judgment. 2.

He further submits that the defendants no.1 and 2 discontinued the use of the impugned mark, soon after a legal notice was sent by the plaintiff on 17th March, 2022, and went back to employment in the IT sector. 3.

This stand is clear from the reply to the aforesaid notice sent on behalf of the defendants no.1 and 2 on 26th April, 2022. 4.

Hence, he submits that the defendants no.1 and 2 would have no objection if a decree of permanent injunction is passed in favour of the plaintiff and against the defendants no.1 and 2. 5.

In view of the above, a decree of permanent injunction is passed in favour of the plaintiff and against defendants no.1 and 2, in terms of prayer CS(COMM) 186/2023 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. clauses 58 a, b, c and d of the plaint.

Further, in terms of prayer clause 58 e of the plaint, the defendants no.1 and 2 are directed to transfer the domain name 'www.isobelkhadi.com', in favour of the plaintiff.

In view of the above, counsel for the plaintiff does not press for remaining reliefs prayed for in the plaint against the defendants no.1 and 2. 8.

Counsel for the plaintiff also does not press for reliefs sought in the plaint against the defendant no.3.

The suit is decreed in the aforesaid terms.

Decree sheet be drawn up accordingly.

Pending applications stand disposed of.
