O R D E R

% 19.01.2018 The present petition has been filed by the petitioner impugning the order dated 13.01.2018 whereby his admission has been cancelled by the respondent No.1-school on the ground that income certificate submitted by his father was found to be fake. Learned counsel for the petitioner submits that he has now submitted a fresh income certificate and prays that in view of same, the respondent No.2 may be directed to verify the authenticity of the certificate. He also prays that pending verification of the fresh certificate by respondent No.2, the respondent No.1 may be directed to re-admit the petitioner. In support of his prayer, he places reliance

on orders passed by this Court in W.P.(C) No.2219/2016,11461/2017, 4849/2016 and 11462/2017.

Mr.Rupendra Pratap Singh, Advocate who appears for respondent No.1 on advance notice, very fairly submits that they are willing to re-admit the petitioner subject to verification of the said certificate by respondent No.2.

The learned counsel for the petitioner undertakes that in case the certificate now submitted by the petitioner is found to be fake or invalid for any reason, respondent no.1 will be entitled to cancel the admission of the petitioner.

The order dated 13.01.2018 is set aside and the writ petition is allowed with a direction to the respondent No.1 to immediately readmit the petitioner in the school. It is however made clear that the said re-admission would remain subject to the verification of the fresh certificate submitted by the petitioner.

The application also stands disposed of.

A copy of this order be given dasti under the signatures of the Court Master.
