The present petition has been filed by the Petitioner- Mr. Ratan Lal, under Article 226 of the Constitution of India, inter alia, seeking directions to the Respondents to allow the Petitioner to peacefully vend from the vending site i.e., Footpath/open Space, Rao Tularam Marg, Near Hanuman Mandir, Basant Village, Vasant Vihar, South Zone, New Delhi (hereinafter, 'vending site') and to conduct the survey of the Petitioner. 3.

vending from the vending site for several years. Reliance is placed upon challans dating back to 2007, issued in his favour. 4.

However, the grievance of the Petitioner is that the survey is not being conducted by the concerned Town Vending Committee. 5.

Heard. It is a matter of fact that the survey in the Hanuman Mandir, Basant Village, Vasant Vihar, South Zone, New Delhi has been completed in January, 2025. In fact, there are other Petitioners who are before this Court, who are vending on the same road, in respect of whom the survey has been completed and survey slips have been issued. The said factum was also raised in W.P(C) 3723/2026 titled Harpal v. Chairman, Town Vending Committee and Ors. today, wherein it was noted that the survey in the said area has been completed in January, 2025.

Therefore, there is no reason why the present Petitioner did not participate in the survey. Once the survey is concluded, the same cannot be reopened in this manner.

Accordingly, the prayer sought for in the present petition is not liable to be granted. The only relief that can be granted is that, if any future survey is conducted by the Town Vending Committee, the Petitioner is permitted to participate in the survey, in accordance with law. 8.

The petition is disposed of in the above terms. Pending applications, if any, are also disposed of.
