CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 19.01.2018 It is submitted that petitioner and respondent no. 2 are neighbours. quarrel took place between them with regard to parking of the car. Respondent no. 2 alleged in the FIR that petitioner shouted, abused and touched her improperly.
Respondent no. 2 is present in Court along with her counsel and has been identified by SI Pradeep Kumar of Police Station Kingsway Camp/Model Town.
Respondent no. 2 submits that she has settled the matter with the petitioner of her own free will and without any
undue force, pressure or coercion, vide a Compromise Deed dated 17th January, 2018, inasmuch as has received entire settled amount of `40,000/- and she has no objection in case the FIR is quashed. Keeping in view the settlement arrived at between the petitioner and respondent no.2 voluntarily, in my view no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, FIR No.388/2010 under Section 354 IPC registered at Police Station Kingsway Camp/Model Town and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
Miscellaneous application is disposed of as infructuous. Dasti.
