% 30.03.2016 This is a petition under Article 226 of Constitution of India seeking directions to respondent No.1 to decide the representation of petitioner dated 28.12.2015 in view of the notification/ office memorandum dated 30.03.2010 of Department of Personnel & Training, Government of India and to perform their public as well as statutory duty with utmost care and caution so as not to deprive the petitioner of his fundamental rights. Learned counsel for the petitioner submits that the petitioner was working with respondent No.3, M/s. Hindustan Insecticides Ltd. She also submits that pursuant to advertisement issued by respondent No.1, the petitioner applied for the post of General Manager (HRD) and the petitioner was appointed as Chief Manager (CP & HRD) vide letter dated 05.02.2008.

She further submits that the respondent No.1 is a public sector undertakings and comes under the supervision of respondent No.2 and governed by all the guidelines issued by Department of Personnel & Training.

As per office memorandum dated 30.03.2010 issued by Department of Personnel & Training, in case of candidates working in the Public Sector Undertakings, who are appointed as direct recruits on or after 01.01.2006, their initial pay may be fixed by granting them the grade pay attached to the said post.

The petitioner made representation dated 08.12.2015 before respondent No.1 and the same has not been decided so far.

Ms. Charu Dalal, Advocate appearing on behalf of respondent No.1, on instructions, submits that the representation of the petitioner dated 08.12.2015 shall be decided within a period of four weeks by passing a speaking order.

Ms. Nishi Chaudhary, learned counsel for the petitioner submits that she is satisfied if the petition is disposed of with directions to respondent No.1 to decide the petitioner's representation. In view of the above, it is deemed appropriate to dispose of the petition with directions to respondent No.1 to decide the petitioner's representation dated 08.12.2015 within a period of four weeks in accordance with law and decision thereof be communicated to the petitioner within a period of one week thereafter.

The petition stands disposed of.
