O R D E R

% 05.02.2018 Status report has been submitted by the State opposing the application.

On behalf of the complainant leaned counsel Mr. Anuj Narula is present and submits that he would be filing his Vakalatnama during the course of the day. The same be filed accordingly. It has further been submitted on behalf of the complainant that the complainant does not oppose the prayer made on behalf of the applicant.

The application is vehemently opposed on behalf of the State. On behalf of the applicant it has been submitted that in view of the decision in order dated 06.01.2018 of the learned ASJ-05, Shahdra, KKD Courts, Delhi to the effect that:

"Keeping in view the totality of the facts and circumstances of the case and the role assigned to the applicant/accused Uday Narula, I am of the considered opinion that this is not a fit case for grant of bail to the

applicant/accused Uday Narula at this stage, the bail application of the applicant/accused is dismissed", at this stage, the learned counsel for applicant seeks to withdraw the present petition seeking liberty to seek redressal before the trial Court. The application is thus dismissed, as withdrawn with liberty granted to the petitioner, as prayed.

Copy of the order be given Dasti, as prayed.
