After some hearing, Mr. Sanjoy Bhaumik, learned counsel for the petitioner, seeks permission to withdraw the petition with liberty to the petitioner to invoke the dispute resolution procedure specified in Clause 25 of the General Conditions of Contract ["GCC"] and Clause 26 of the Special Conditions of Contract ["SCC"].

Mr. Varun Nischal, learned counsel for the respondent, states that the petitioner is required to approach the General Manager of the respondent in terms of Clause 26 of the SCC. Failing a satisfactory resolution of the disputes, a reference then be made to the Dispute Redressal Committee which is already constituted and will give its decision within the time stipulated in the SCC. Mr. Nischal assures the Court that both the authorities will give the decision in accordance with the time stipulated in the SCC. with this procedure, the petitioner will be at liberty to invoke arbitration at that stage.
