% 21.02.2019 The learned senior counsel for the petitioner, on instructions, submits that he may be allowed to withdraw the present petition and the application filed therewith since the petitioner seeks to approach the court of Sessions for the relief of anticipatory bail, his only apprehension being that the observations in the order dated 29.01.2019 of the Metropolitan Magistrate, whereby the prayer for cancellation or recall of non-bailable warrant was rejected may come in the way. It is trite that such observations will not be binding the court of Sessions.

The petition and the application filed therewith are dismissed as withdrawn.
