Pursuant to the order dated 18.2.2019, learned counsel for the petitioner states on instructions from his client that the missing person described in the present petition as a Nigerian citizen is the very same person, who holds a South African passport in the name of 'Kingston Dube'. He states that in view of the fact that the whereabouts of the said person having been disclosed by Mr. Rahul Mehra, Standing Counsel (Crl.) on the last date of hearing, the grievance in the present petition does not survive any longer.

This leaves us with the issue that was flagged in para 6 of the order dated 18.2.2019. Mr. Bhardwaj, learned CGSC enters appearance on behalf of the FRRO and states that an affidavit has been drafted but he needs further time to file the same. We have made certain enquiries from him as to the manner in which the FRRO proceeds on the Visa of a foreign national expiring. He states that this aspect shall also be dealt with in the affidavit proposed to be filed. The said affidavit shall be filed within two weeks with copy to the Standing Counsel (Crl.), GNCTD. On the next date of hearing, a senior officer from the FRRO shall remain present to assist the Court. 3.

While disposing of the present petition insofar as the relief prayed for by the petitioner is concerned, list on 04.4.2019 to await the affidavit of FRRO.
