Learned counsel for the petitioner, on instructions, fairly submits that during the pendency of the petition the pensionary benefits have been released, however, the grievance with regard to interest on delayed payment remains.

In view of the above, the petition is disposed of as infructuous with liberty to the petitioner to file a representation claiming interest on the delayed payment of retiral benefits.

In the eventuality of the petitioner filing a representation within three weeks from today, the respondent no.3 shall decide the same by passing a speaking order, in accordance with law, expeditiously and not later than three weeks from the receipt of the representation. In case the petitioner is found entitled to interest, the payment shall be credited in the account of the petitioner within three weeks thereafter. 5.
