By way of this petition filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 (hereinafter „the Act‟) petitioner seeks appointment of an Arbitrator to adjudicate the disputes between the parties arising out of Performance Linked Turnkey Activity Based Bus Operator Agreement dated 16.05.2022. Arbitration clause is clause 22.3.4 of the said agreement.

The disputes having arisen between the parties, petitioner invoked the arbitration clause by giving notice dated 24.10.2025 which was responded by respondent no.1 vide response dated 22.11.2025 whereby the claims of the petitioner were disputed.

In this backdrop, petitioner had approached this Court under Section 11 of the Act by filing the present petition. Notice in the petition was issued by this Court when the matter was first listed on 24.03.2026.

Mr. Anubhav Lamba, Advocate appeared on behalf of respondent no.1 on 24.03.2026 and accepted notice, while notice was issued to respondent no.2.

Today, Mr. Anagh Mishra, Advocate has entered appearance on behalf of both the respondents and states that the existence of arbitration clause is not in dispute, and respondents have no objection in case sole arbitrator is appointed to adjudicate the disputes. 7.
In view of the submissions of Mr. Mishra, present petition is allowed. 8.
The disputes between the parties are referred to arbitration of Mr. Amit Tiwari, Advocate [Mob. 8527271621].

The arbitration will be held under the aegis of Delhi International Arbitration Centre, Delhi High Court, Sher Shah Road, New Delhi - 110003 ["DIAC"] and shall be governed by the Rules of DIAC including as to the remuneration of the learned Arbitrator. The DIAC may register the case forthwith.

The learned Arbitrator is requested to furnish a declaration under Section 12 of the Act prior to entering upon the reference. 11.
It is made clear that all rights and contentions of the parties are left open for adjudication by the learned Arbitrator. 12.
Petition stands disposed of.
