% 18.01.2018 FIR No. 49/2011 under Sections 384/323/342/34 IPC was registered at police station Baba Haridass Nagar on the complaint of respondent no.2. Respondent no.2 alleged in the FIR that petitioners had illegally restrained the respondent no. 3 and took his motorcycle and forced the respondent no.2 to pay them about `10,000/-.
They also snatched his motorcycle after extending beatings to him and respondent no.3. During the investigation, offences under Sections 365/392/395 IPC were added and Section 384 IPC was deleted.
It is submitted that petitioners and respondent nos. 2 and 3 have settled their disputes amicably with the intervention of their common friends and other family members, therefore, aforesaid FIR and the consequent proceedings may be quashed.
Respondent nos. 2 and 3 are present in Court and have been identified by SI Sunder Singh of police station Baba Haridass Nagar. Respondent nos. 2 and 3 submit that they have settled the matter with the petitioners of their own free will and without any undue force, pressure or coercion, therefore, they do not wish to pursue the FIR any further and the same may be quashed.
Keeping in view that petitioner 3 is related to respondent no.3 and that a quarrel ensued between them on some trivial matter which led to the above incident and, consequently, registration of FIR and now that petitioners and respondent nos. 2 and 3 have settled their disputes amicably, I am of the view that no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
