The petitioner has filed the present petition, inter alia, praying that the petitioner be released on parole on the ground that the petitioner desires to file a Special Leave Petition to challenge the order dated 20.09.2019, passed by this Court dismissing the petitioner's appeal against his conviction and the order on sentence.

The petitioner now prays that he be released on parole as his mother has expired on 02.02.2020. He requires to perform the last rites. 3.

A status report has been filed, which indicates the fact that the petitioner's mother expired on 02.02.2020 has been verified from the SHO of Police Station Sikandrabad, District Bulandshahr, Uttar Pradesh. 4.

A nominal roll has been filed, which indicates that the petitioner has already served a substantial portion of his sentence and is now required to serve a further period of four years, four months and twelve days. The petitioner was also released on interim basis from 05.03.2019 to 12.03.2019

and there is no allegation that he has misused his liberty. His conduct in the jail for the last one year is also reported to be satisfactory. 5.

In the given circumstances of the case, this Court considers it apposite to allow the present petition and directs that the petitioner be released on parole for a period of two weeks. The petitioner shall be released on parole on his furnishing a personal bond in the sum of ₹10,000/- with one surety of an equivalent amount to the satisfaction of the Trial Court. 6.

The petitioner shall also provide his mobile number and ensure that he is reachable at all times. He shall proceed directly to his village to perform the last rites and surrender immediately on his return. The petitioner shall mark his presence with the Police Station Sikandrabad on his release. He shall also do the same after six days, thereafter. 7.

The petition and the application are disposed of in the aforesaid terms. 8.
