Petitioners seek quashing of FIR No. 35/2013 of PS Connaught Place for offence under Section 420/468/471/120B/34 IPC. The quashing is sought only on the ground that petitioners have compromised the disputes with the complainant de facto (respondent no.2).

A query is raised to learned counsel for petitioners as to how the inherent powers can be invoked to quash the subject proceedings since the allegation is not a personal wrong between two parties. The present case is not a simple case of loan transaction between petitioners and respondent no.2. The allegation against the petitioners is that they forged government documents to avail loan. Attention of learned counsel for petitioners is also brought to the portion of the FIR (at pdf 36). 5.

After addressing partly, learned counsel for petitioners on instructions of his clients present in Court, seeks permission to withdraw this petition. 6.

Accordingly, the petition is dismissed as withdrawn.
