This petition challenges the order dated 24.04.2019 passed by the learned Central Administrative Tribunal, Principal Bench, New Delhi (hereinafter referred to as, 'Tribunal') in O.A. No. 2598/2013, titled Birpal Singh & Ors. v. Govt. of NCT of Delhi & Ors. and other O.As., disposing of the said O.As. with certain directions. A similar challenge was made to the said order passed in O.A. No. 2693/2018 wherein a Coordinate Bench of this Court, by its judgment dated 15.10.2024 passed in W.P.(C) 8914/2019, titled Lokpal Singh Negi v. GNCT of Delhi & Ors., opined that the learned Tribunal should not have disposed of the batch of petitions by a common judgment without appreciating the peculiar facts of each of the O.As.. matter back to the learned Tribunal for deciding the O.A. afresh. 2.

We have examined the facts of the present case and are inclined to adopt the same result. Accordingly, the order dated 24.04.2019 passed in O.A. No. 2598/2013 is hereby set aside. The present O.A. is remanded back to the learned Tribunal for fresh consideration on its merit. The O.A. is restored back to its original number. 3.

The parties shall appear before the learned Tribunal on 25th November, 2025.

We make it clear that we have not expressed any opinion on the merits of the case or the contentions raised by either of the parties, which shall be considered by the learned Tribunal remaining uninfluenced by the Impugned Order or the Order passed by us today. 5.
