Petition under Section 482 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner for quashing of FIR No. 482/2018 under Section 363 IPC registered at P.S.: Nihal Vihar and proceedings emanating therefrom. Chargesheet has been filed under Sections 363/366A/376 IPC.

Learned counsel for the petitioner submits that respondent no. 3 had voluntarily left the parental house and was a major at the time of registration of FIR.

However, learned APP for the State, on instructions of the Investigating Officer, submits that respondent no. 3 / victim was merely aged about 13 1⁄2 years at the relevant time and the same is supported by the school record. She further submits that being a minor, respondent no. 3 could not legally marry the petitioner.

stands recorded, learned counsel for the petitioner, without prejudice to the rights and contentions does not press the petition and prays that learned Trial Court may be directed to expedite the proceedings, since statement of the material witnesses already stands recorded.

Considering the totality of facts and circumstances, an endeavour shall be made by the learned Trial Court to conclude the trial preferably within a period of four months from the next date of hearing fixed before the learned Trial Court.
Petition is accordingly disposed of. Pending applications, if any, also stand disposed of.
A copy of this order be forwarded to learned Trial Court for information and compliance.
