% 19.03.2019 The present petition under Article 226/227 of the Constitution of India read with Section 482 Cr.P.C has been filed on behalf of the petitioner seeking quashing of the FIR No. 608/2018, under Section 3 of Delhi Prevention of Defacement of Public Property Act, 2007 registered at PS Vasant Kunj.
From the perusal of the record, it transpired that the petitioner has deposited a sum of Rs. 50,000/- with the Municipal Treasury on 27.12.2018 and pursuant to the deposit of amount of Rs.50,000/-, South Delhi Municipal Corporation vide letter dated 27.12.2018 informed the SHO, PS Vasant Kunj, North, that M/S AMBIENCE COMMERCIAL DEVELOPERS PVT.
LTD had compounded the offence under Section 4(1) of the D.P.D.P. Act, 2007 and that no further action is required.
Vide letter dated 27.12.2018, filed on record by SDMC, which is not disputed by the counsel appearing for SDMC, no further action is required. Keeping in mind that the aforesaid offence is compoundable, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.
The petition is disposed of.
