CORAM:

HON'BLE MS. JUSTICE MUKTA GUPTA

O R D E R

% 19.01.2018 Crl. M.A. No. 1136/2018 (Exemption) Allowed, subject to all just exceptions.

W.P.(CRL) 200/2018 By this petition the petitioners seeks quashing of FIR No. 439/2012 under Sections 307/324/34 IPC registered at PS Kalkaji, Delhi on the complaint of respondent No. 2 and the proceedings pursuant thereto on the ground that the parties have settled the matter. The petitioners have earlier filed a writ petition before this court being W.P. (Crl.) No. 3437/2017 seeking the same relief which petition was dismissed as withdrawn by learned counsel for the petitioners after having taken instructions. The ground in the present petition is that since the junior counsel appeared he could not satisfy the court that it was a fit case for W.P.(CRL) 200/2018

quashing of the FIR and the proceedings pursuant thereto on the ground of compromise.

A perusal of the FIR reveals that the petitioners caused injuries to Vishal by knife and iron rods resulting to the extent that the intestine of Vishal protruded.

Considering the nature of injuries caused and the manner of attack indicating seriousness of the offence, this Court finds no ground to quash the FIR and the proceedings pursuant thereto on the ground that the parties have compromised the matter.

Petition is dismissed.

MUKTA GUPTA, J.
