Learned counsel appearing on behalf of the plaintiff, on instructions, submits that a Suit for Perpetual and Mandatory Injunctions, had been filed. However, because of the subsequent developments new facts have emerged which need to be incorporated in the plaint. Therefore, permission has sought to withdraw the present Suit with liberty to file afresh. 2.

Learned counsel for the defendant No. 2 has no objection to the withdrawal of the Suit.

In view of the submissions made, the Suit is permitted to be withdrawn with the liberty as prayed for. The pending applications also stand disposed of.
