By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with Article 227 of the Constitution of India, the petitioner, inter alia, seeks setting aside of the order dated 06.02.2026 passed by learned ASJ-08, West District, Tis Hazari Courts, Delhi (learned Sessions Court) in CA No.500/2025 insofar as it disposes of the appeal based on the statement of the appellant therein qua the settlement of disputes.

Out of the grounds taken, primarily, it is the case of the petitioner that an application for seeking withdrawal of the said appeal before the learned Sessions Court was filed pursuant to the order dated 11.12.2025 passed by this Court in CRL.M.C. 8885/2025, particularly, in view of paragraph 6 therein.

Learned counsel for petitioner submits that though the said application was taken up on 06.02.2026, whence the statement of the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. petitioner was recorded, however, it was inadvertently recorded that "I want to withdraw the present appeal as I have settled all my disputes with the respondents.". This, according to leaned counsel was/ could not have been the intention of the petitioner as it would have tantamounted to withdrawal of the Protection of Women from Domestic Violence Act, 2005 complaint itself.

In effect, learned counsel for the petitioner seeks a modification of the statement recorded before the learned Sessions Court on 06.02.2026 based whereon the impugned order dated 06.02.2026 has been passed. 5.

After some arguments, learned counsel for the petitioner seeks to withdraw the present petition with liberty to seek appropriate remedies, including filing an application seeking modification of the aforesaid statement in accordance with law before the learned Sessions Court. 6.

Considering the same, as also particularly since the present proceedings arise out of a matrimonial dispute, the present petition, alongwith the pending application, is dismissed as withdrawn with liberty as prayed for.
