The petitioner is aggrieved by the investigation being carried out in connection with FIR No. 28/2026 dated 13.02.2026, registered at Police Station Hari Nagar, District West, Delhi, under Section 69 of the Bharatiya Nyaya Sanhita, 2023, and has already approached the Court of Chief Judicial Magistrate, District West, Tis Hazari Courts, Delhi, ["Magistrate's Court"] by way of an application under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 2.
As this petition has been filed for virtually the same relief, Mr. Dushyant Bhargava, learned counsel for the petitioner, seeks permission to pursue the petitioner's case before the Magistrate's Court. He, however, submits that the learned Magistrate may be requested to proceed expeditiously.

requested to take up the matter as expeditiously as possible and pass necessary orders in accordance with law.

Mr. Rahul Tyagi, learned Additional Standing Counsel for the State, submits that the State will also cooperate in the process of expeditious disposal of the application before the learned Magistrate. 5.
It is made clear that no notice has been issued to respondent No. 2, and the observations in this order are not intended to be a comment on the veracity of the allegations raised by the petitioner against respondent No. 2 or on the merits of the case pleaded by the petitioner. 6.
The petition is dismissed as withdrawn with the aforesaid observations.
