The only request of the petitioner in this writ petition under Article 226 of the Constitution is that an appeal, which has been filed by him against a Disciplinary Order of the respondent-North East Transmission Company Limited ["Company"] dated 31.10.2024, be disposed of in a time bound manner.

By the said order dated 31.10.2024, the disciplinary authority imposed a major penalty of removal from service upon the petitioner. has lodged an appeal against the aforesaid order on 29.11.2024, and has issued reminders for a decision to be taken on his appeal. 3.

Mr. Abhishek Puri, learned counsel for the respondent-Company, who appears on advance notice, submits that the respondent disputes the contention of the petitioner, that it falls within the definition of "State" under Article 12 of the Constitution, and therefore, contests the maintainability of a writ petition against it. 4.

Without prejudice to this submission, in view of the nature of the relief sought by the petitioner, Mr. Puri states, upon instructions, that the appellate authority in question is the Board of Directors of the respondent-Company, and the said appeal will be placed before the Board of Directors at its very next meeting.

In view of the aforesaid statement of Mr. Puri, it is expected that final decision in the matter will be taken within the next four months. 6.

The writ petition is disposed of.

It is made clear that this Court has not adjudicated upon any disputed contentions, including the contention with regard to the maintainability of the writ petition.
