The present writ petition has been filed seeking a direction to the respondents to inspect the property being Laxmi Apartment, Plot No.3, A-2 Block, Chhattarpur Extension, New Delhi ('subject property') and stop the unauthorized illegal construction being carried out in the said property by respondent no.5. Photographs have been filed along with writ petition showing unauthorized construction.

Counsel appearing on behalf of respondent no.1/MCD on advance notice submits that a show cause notice has been sent to the owners/occupiers of the subject property stating that construction in the terrace of the fourth floor is unauthorized construction. Subsequently, intimation in this regard has also been sent to the Sub-Registrar, Mehrauli on 23rd March, 2026 and to the BSES Rajdhani Pvt. Ltd. calling upon them to disconnect the electricity connection.

It is submitted that a work stop notice has also been issued to SHO, Mehrauli Police Station on 23rd March, 2026.

In light of the aforesaid submissions, the present writ petition is disposed of while directing respondent no.1/MCD to take expeditious action in accordance with law.

Respondent no.1/MCD as well as SHO, Mehrauli Police Station, shall ensure that no unauthorized construction is carried out. 6.

Liberty is given to the petitioner to take appropriate remedies available in law in the event the petitioner has further grievances. 7.

All rights, contentions and legal remedies of the private respondent are kept open.
