Ms.Vatsala Singh, Advocate versus GOVT. OF NCT OF DELHI ... Respondent Represented by:
Mr.Sanjay Lao, ASC for the State
CORAM:
HON'BLE MS. JUSTICE MUKTA GUPTA
O R D E R
% 20.02.2019 1.
By the petition the petitioner seeks extension of parole on the ground that his house is under repair. Vide communication dated 31st December, 2018 the petitioner was granted parole by the Government of NCT of Delhi for a period of two weeks on the ground that the house of the petitioner has to be repaired.
2.
A Status Report has been filed verifying the fact that the construction/repair of the house is in progress. The family of the petitioner comprises his mother, wife and four children. 3.
Considering that the construction work is going on though parole cannot be extended for a period of two months, however, this Court deems it fit to grant extend parole of the petitioner for a further period of two weeks. 4.
It is therefore directed that the parole of the petitioner granted by the Government of NCT of Delhi vide communication dated 31st December, W.P.(CRL) 534/2019
2018 is extended for a further period of two weeks on the same terms and conditions as imposed in the said order.
5.
Though learned counsel for the petitioner prays that further parole be granted but considering the fact that the petitioner was out on suspension of sentence pending hearing of the appeal and could have repaired the house in the year 2017 when he was out, this Court does not deem it fit to grant further extension of parole beyond a period of two weeks. 6.
Petition is disposed of. Order Dasti.
Crl.M.A.3689/2019 Dismissed as infructuous.
