O R D E R

The petitioner has filed the present petition, inter alia, praying that the petitioner be released on parole for a period of three months. 2.

The petitioner's application for seeking parole was rejected by an order dated 10.01.2020, on the ground that it had not been verified whether he is eligible for furlough. This is necessary, because if a prisoner is eligible for furlough, then his application for furlough is to be considered prior to forwarding his application for parole.

Mr Lao, learned ASC submits that the petitioner has applied for furlough but his application has not been considered till 17.02.2020. 4.

The petitioner's nominal roll has been handed over, which indicates that he was last released on parole on 22.10.2018 for a period of four weeks. 5.

In the aforesaid view, there is little doubt that the petitioner would be entitled to parole. His conduct in the jail has been reported to be satisfactory.

As on 17.02.2020, the petitioner has already served actual custody of seventeen years, eleven months and four days and during the said period, earned remission of three years, six months and seventeen days. 6.

In view of the above, the present petition is allowed and the petitioner is directed to be released on parole for a period of four weeks from the date of his release, subject to his furnishing a personal bond in the sum of ₹10,000/- and one surety of an equivalent amount to the satisfaction of the concerned Jail Superintendent. This is also subject to further conditions: (a) The petitioner shall furnish a mobile number and ensure that he is reachable at all times.

(b) He shall surrender on or before the completion of the period of parole.
