At the outset, Mr. Pawanjeet Singh Bindra, ld. Sr. Counsel for the Petitioners seeks permission to withdraw the present petition with liberty to give better particulars and file an amended writ petition. 3.

On behalf of the LAC and DDA, it is pointed out that in respect of this very award and the execution proceedings in Sahyoorpur, New Delhi, the Petitioner No. 4 had challenged the execution and the same has been confirmed by the Supreme Court vide judgment dated 6th May, 2022, being Delhi Development Authority v. Godfrey Phillips (I) Limited and Others, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The relevant events in the present petition as also in the decision of Delhi Development Authority v. Godfrey Phillips (I) Limited and Others (Supra) are as under:

A perusal of the above would show that the Notifications under challenge and the Award under challenge are the same as in the decision in Godfrey Phillips (supra). Thus, this Court is of the opinion that the present petition ought to have disclosed this particular judgment as also the fact that the Petitioner No. 4 had earlier filed writ petition which was allowed by this Court in Godfrey Phillips (I) Limited v. Union of India, 2016 SCC Online Del 6324. However, the said judgment passed by this Court was set aside by the Supreme Court vide judgment dated 6th May, 2022. 6.

In the opinion of this Court, the acquisition having been already upheld, the present petition is not maintainable. The same is accordingly dismissed. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
