% 18.02.2020 This is a petition filed by the petitioner under Section 439 Cr.P.C. seeking interim bail on the ground that his wife is not well and she is to be operated for ovarian cyst.

Doctor Ajay Singh Pundeer is present in person. He submits that he has examined the wife of the petitioner and her medical documents show that she is suffering from ovarian cyst which needs to be surgically removed.

He further submits that wife of the petitioner had taken date for the second time for this operation but she has not turned up. It is submitted that now the admission is planned for 24.02.2020 and her surgery is planned for 25.02.2020. Learned APP for the State has vehemently opposed the grant of interim bail to the petitioner on the ground that petitioner is a habitual offender and is involved in 27 cases, mostly under Sections

392/394/397 IPC. It is further submitted that petitioner has brother, mother and sister-in-law in the family who can take care of the wife of the petitioner.

It is submitted by learned APP for the State that wife of the petitioner is resident of Buland Shehar and she is getting treatment from Metro Plus Hospital which is situated at Najafgarh. This, according to learned APP, does not strike to logic. Looking into the antecedents of the petitioner and also the fact that he has lady members in his family, no ground is made out for grant of interim bail.

The application is accordingly dismissed.
