This petition is filed on behalf of the Petitioner under Article 227 of the Constitution of India laying a challenge to order dated 21.02.2026 passed by learned District Judge (Commercial Court-02), Tis Hazari Courts, Delhi, whereby interim relief has been declined on an application under Order XXXIX Rules 1 and 2 CPC.

Petitioner herein is the Plaintiff in the suit pending before the learned District Judge seeking permanent injunction against the Defendant for copyright infringement in respect of literally work 'Kubernath Rai Rachnavali'. XXXIX Rules 1 and 2 CPC for grant of ex parte ad interim injunction with three reliefs. From a reading of the impugned order dated 21.02.2026, it appears that the Petitioner broadly argued on restraining the Defendant from displaying or selling the book in question at the proposed book launch event scheduled on 22.02.2026 and for the reasons stated in the order this interim relief was denied. Since the event is over, to this extent the impugned order warrants no interference. However, as rightly flagged by counsel for the Petitioner, the interlocutory application has two other prayers, which need consideration. Accordingly, this petition is disposed of requesting the learned Commercial Court to consider the interlocutory application with respect to prayers (a) and (b) on the next date i.e., 23.04.2026, in accordance with law.

It is made clear that this Court has not expressed any opinion on the merits of the case.
