$~24 * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) 1386/2020 SIDDHI VINAYAK COLLEGE ..... Petitioner Through:
Mr. Mayank Manish with Mr. Ravi Kant, Advocates.
versus NATIONAL COUNCIL FOR TEACHERS EDUCATION AND ANR.
..... Respondents Through:
Ms. Arunima Dwivedi, Standing counsel with Ms. Niharika Rai, Advocate.
CORAM:
HON'BLE MR. JUSTICE RAJIV SHAKDHER
O R D E R
% 07.02.2020 1.
Issue notice to the respondents.
2.
Ms. Arunima Dwivedi accepts notice on behalf of the respondents.
3.
In view of the directions that I intend to pass, Ms. Dwivedi says that she will advance arguments in the matter based on the record, presently, available.
4.
The substantive prayer made in the writ petition is as follows:- " issue an appropriate writ[s]/direction[s] or order[s] directing the WRC to conduct the expert visit of the petitioner institution to verify the infrastructural and instructional facilities and to decide the application of the petitioner institution within a reasonable time as cut off date for grant of recognition for academic session 2020-21 is 03.03.2020;"
W.P.(C) 1386/2020
5.
A perusal of the aforementioned prayer would show that the petitioner seeks a limited direction from this Court i.e. that the expert committee of the Western Regional Committee (in short "WRC") should conduct an inspection with regard to its infrastructural and instructional facilities.
6.
To be noted, the petitioner claims that this prayer is made in the context of application preferred by the petitioner qua the B.Ed. Course in 2015.
7.
Accordingly, the writ petition is disposed of with a direction to the WRC to adjudicate upon the Show Cause notice dated 06.08.2019 (in short "SCN").
7.1 In adjudicating upon the SCN, it will consider the reply dated 02.09.2019.
7.2 The adjudication will be carried out before the cut off date fixed for academic session 2020-2021.
7.3 I am informed by Ms. Dwivedi that the cut off date, presently, fixed is 03.03.2020.
8.
It is made clear that if necessary WRC will be at liberty to inspect the infrastructure and institutional facilities of the petitioner. The WRC will do the needful as well before the cut off date. RAJIV SHAKDHER, J FEBRUARY 07, 2020 c W.P.(C) 1386/2020
