Mr. J. Sai Deepak, learned Senior Counsel appearing for the plaintiff, on instructions of the plaintiff, states that he seeks to withdraw the present suit with the liberty to file fresh suit. He also prays for refund of Court Fees. 2.

In view of the above, the present suit is dismissed as withdrawn with the liberty as prayed.

In terms of Section 16 of the Court Fees Act, 1970, the Court Fees be refunded to the plaintiff upon completion of all the formalities, as per rules.
