A Criminal Writ Petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. has been filed on behalf of the Petitioner for directing the Respondent to investigate the matter under Section 307/326/506/120B IPC in FIR No.989/2023 dated 24.12.2023 under Section 325 IPC.

It is a settled law that on the basis of a Complaint, FIR may be registered under a particular Section, but there is nothing to prevent the Police or the Investigating Agency to amend or file the Chargesheet under the Sections which are made out after the investigations. Since, as per the Petitioner himself the investigations are still ongoing in the FIR and the Chargesheet is yet to be filed, the directions as sought are not sustainable in law.
