The present Applications, under Section 151 of the Code of Civil Procedure, 1908 ["CPC"], have been filed, inter alia, seeking vacation of the status quo Order dated 25.03.2026 passed by this Court and further seeking restraint against the Petitioner from issuing any further communications to banks or third parties allegedly misrepresenting the directions contained in the aforesaid Order. 2.
At the outset, Mr. Jayant Mehta, learned Senior Counsel appearing on behalf of the Petitioner/Non-Applicant, tenders an unconditional apology on behalf of the Petitioner for the communication annexed as Document-3 to the present Applications and submits that it is unfortunate that such intemperate language came to be employed therein.

Learned Senior Counsel further submits that immediately upon the said communication being brought to his notice, appropriate instructions were issued to withdraw the same and accordingly, the said communication has since been unconditionally withdrawn vide communication dated 14.05.2026.

He further submits, on instructions, that no further communications shall be addressed by the Petitioner to the banks or any third parties in relation to the subject matter of the present proceedings.

In view thereof, Prayer (c) of the Applications stands satisfied. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Mr. Rajshekhar Rao, learned Senior Counsel appearing on behalf of the Respondent/Applicant, submits that the status quo Order dated 25.03.2026 is liable to be vacated inasmuch as the same is founded upon facts which, according to him, were either not disclosed before this Court or were incorrectly represented at the time of passing of the said Order.

It is his submission that the foundation of the interim protection having been laid on alleged concealment and misrepresentation, the continuance of the said Order would amount to perpetuation of an inequitable relief.

On this aspect, learned Senior Counsel appearing on behalf of the Petitioner, however, submits that the matters were heard at considerable length prior to the passing of the Order dated 25.03.2026 and all the aforesaid contentions had already been canvassed before this Court and duly considered while granting the interim protection. 9.
At this stage, learned Senior Counsel appearing on behalf of the parties jointly submit that since arbitral proceedings have already commenced, though the learned Arbitral Tribunal is yet to be formally constituted, all disputes and issues sought to be raised by way of the present Applications, including I.A. 13580/2026 and I.A. 13606/2026, may be permitted to be urged before the concerned Arbitral Tribunal. 10.
The aforesaid request is considered and accepted. Leave and liberty, as sought for, are granted.

It is clarified that none of the observations made either in the present Order or in the earlier Orders passed by this Court shall be construed as an expression on the merits of the disputes between the parties, and all rights and contentions of the parties are left open to be agitated before the learned Arbitral Tribunal in accordance with law. Accordingly, the present Applications, along with all pending application(s), stand disposed of in the aforesaid terms.
