BAIL APPLN. 355/2020 1.

This is a petition filed by the petitioner under Section 438 Cr.P.C. seeking grant of anticipatory bail in case FIR No. 412/2019 under Sections 352/427/308/34 IPC registered at Police Station Krishna Nagar, Shahdara, Delhi.

Learned APP for the State enters appearance and accepts notice.

As per the allegations, complainant on 30.11.2019 was sitting in a room, when at about 10:00 p.m. co-accused, namely, Priya and

Anita entered her room. Priya hit the complainant's head with iron rod and Anita abused her.

In the meanwhile, other co-accused, namely, Kamal and Balraj threw bricks and pelted stones upon her but somehow she did not receive injuries. It is further alleged by her that in the meanwhile petitioner along with one Pradeep also came there and he also threw bricks by which fridge, pot and chiks of the petitioner were broken.

The petitioner was, thereafter, taken to hospital.

The only allegation against the petitioner is that she had abused the complainant It is also stated that co-accused has already been granted bail.

Learned APP for the State is insisting for filing a status report. However, in my opinion, looking into the facts and circumstances of the case, no specific purpose will be served by filing the status report and it will only delay the matter.

Be that as it may, keeping in view the facts and circumstances of the case, it is ordered that in the event of arrest, the petitioner be released on bail on his furnishing a personal bond in the sum of Rs.20,000/- with one surety in the like amount, subject to the satisfaction of the IO/SHO concerned. However, the petitioner shall join the investigation as and when required by the IO. 8.

A copy of the order be given dasti under the signature of the Court Master.
