O R D E R

By way of this application, the Applicant seeks modification of the bail condition contained in Paragraph No. 12(b) of the order dated 2nd July, 2025, seeking permission to shift to his parental home to ensure that his wife, who is undergoing a difficult pregnancy would get care and safe environment.

The Court has heard Mr. Mukesh Kumar, APP for the State, the Prosecutrix, who is present along with her counsel and Sub-Inspector Sunil Chandra, P.S. Ambedkar Nagar. It transpires that subsequent to the aforesaid bail order, the Prosecutrix has shifted her residence, which as per the Investigating Officer, is situated at a distance of approximately 800 metres The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. or more from the parental home of the Applicant. 3.

In view of the aforesaid change in circumstances, and considering that since the passing of the bail order no complaint alleging violation of the bail conditions has been received by the State, this Court is inclined to allow the request. S.I. Sunil Chandra further confirms that the Applicant's spouse, who is residing with him, is undergoing a difficult pregnancy. Taking into account the said humanitarian ground, along with the absence of any complaint of misuse of liberty, the application is allowed. 4.

Accordingly, the condition contained in paragraph No. 12(b) of order dated 2nd July, 2025 is modified to the limited extent that the Applicant shall be permitted to shift to and reside at his parental home located at BH-22, Ground Floor, Madangir, Dr. Ambedkar Nagar, New Delhi. 5.

It is, however, made clear that the Applicant shall not, at any point of time, directly or indirectly contact the Prosecutrix or any of her family members. The concerned Investigating Officer shall periodically remain in touch with the Prosecutrix to ascertain whether she perceives any threat from the Applicant. In the event any formal complaint is made, the same shall be duly considered, in accordance with law. 6.

It is further clarified that all the other bail conditions shall remain intact. The safeguards and protections available to the State as well as the Prosecutrix shall continue to operate in terms of Paragraph Nos. 12 and 13 of the order dated 2nd July, 2025.
