% 11.04.2018 By this petition the petitioner seeks parole on the ground of filing SLP and maintaining social ties and also challenges the communication dated 6th December, 2017 rejecting his application of parole on the ground that it may harm the victim/witness, adversely affect the law and order/security situation in the area and jump parole, if released. On a notice being issued a Status Report has been filed. As per the Status Report, family of the petitioner comprising of his mother and younger brother are residing at H.No.47/19, Khatik Mohalla, Rajpura Gud Mandi, Delhi whereas his elder brother Akash, who is married, is residing with his wife in Pujabi Basti.

Learned proxy counsel for learned Additional Standing Counsel for the State on instructions from the Investigating Officer, who is present in Court, states that the mother of the petitioner is willing to stand surety for the petitioner. The petitioner has been in custody for more than five years and has roots in the society.

Considering the facts mentioned in the Nominal Roll and the Status Report, this Court deems it fit to grant parole to the petitioner. It is, therefore, directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court/CMM concerned. Petition is disposed of.

A copy of this order be communicated to the petitioner through Superintendent, Mandoli Jail.
