+ W.P.(CRL) 191/2018 DHANI RAM ..... Petitioner Through :

Mr.Azhar Qayum, Advocate.

versus STATE ..... Respondent Through :

Ms.Kamna Vohra, ASC.

CORAM:

HON'BLE MR. JUSTICE S.P.GARG

O R D E R

% 19.01.2018 1.

The present writ petition has been filed by the petitioner seeking parole for three months in case FIR No.53/1995 under Sections 20/61/85 NDPS Act registered at Police Station NDRS. Status report not filed.

2.

Nominal roll dated 08.01.2018 reveals that the petitioner was convicted under Sections 20/61/85 NDPS Act and was sentenced to undergo Rigorous Imprisonment for ten years within fine `1,00,000/-. In Crl.A.No.485/00, the sentence has been reduced to Rigorous Imprisonment for five years with fine `50,000/-. The petitioner is in custody only for a period of one year, five months and twenty four days as on 06.01.2018. It is too early to grant parole to the petitioner as he was sent to custody only on 23.03.2017. 3.

Considering the facts and circumstances of the case, I find no sufficient ground for grant of parole.

4.

The writ petition is dismissed.
