% 24.03.2026 I.A. 6494/2026 (Joint application under Order XXIII Rule 3 read with Section 151 CPC by the parties for recording of settlement and for disposal of suit in terms of the settlement) 1.

The present application has been jointly filed by the parties for disposal of the suit in terms of settlement agreement dated 10.02.2026. 2.

Learned counsel for the parties submits that during the pendency of the suit, the disputes were referred to mediation, where parties arrived at settlement, terms whereof have been reduced in writing in the form of settlement agreement dated 10.02.2026, copy of which has been annexed as document no.1 to the present application.

Attention of the Court has been drawn to the aforesaid settlement, a perusal of which shows that same has been signed by all the parties to the suit.

proceedings through VC. The plaintiff as well as the defendants affirm the factum of settlement and pray that the suit be disposed of in terms of settlement agreement.

Having perused the terms of settlement agreement, this Court finds that the same are lawful. Therefore, there is no impediment in disposing of the suit in terms of the settlement.

Accordingly, application is allowed and the suit is disposed of in terms of the settlement agreement dated 10.02.206, which shall form part of the decree.

The parties shall remain bound by the terms of the settlement. 8.
