% 28.08.2024 CS(OS) 138/2021 & I.A. 37750/2024 (under Order XXIII Rule 3 CPC on behalf of the parties) 1.
The present application has been jointly filed by the plaintiff, as well as, the defendant praying for passing a compromise/consent decree in terms of the settlement arrived at between the parties. 2.
The suit was filed by the plaintiff praying for permanent injunction, mandatory injunction and damages. During the pendency of the suit the parties were referred to the mediation vide order dated 07.03.2024. 3.
Before the mediation, the parties arrived at settlement terms whereof were reduced in writing in the form of a settlement agreement dated 15.07.2024 which has been annexed to the present application as AnnexureA. The settlement agreement has also been received from the learned by both the parties, as well as, by their respective counsels and the learned Mediator.

I have perused the settlement and find the same to be lawful. Thus, there is no impediment in disposing of the suit in terms of the settlement. The parties shall remain bound by the terms of the settlement. 6.
Accordingly, the suit is decreed in terms of the settlement dated 15.07.2024, which shall form part of the decree. 7.
The application, as well as, the suit stands disposed of in the above terms.
