The challenge in this petition is to an arbitral award dated 17.03.2015, by which an award was made in favour of the petitioner to the extent of Rs.1,85,66,300/- [inclusive of interest until the date of the award], and further interest thereupon.

The challenge of the respondent to the aforesaid award was rejected on the ground of delay, by an order dated 30.08.2017 in O.M.P. 436/2015. The order was upheld by the Division Bench vide judgment dated 16.02.2018 in FAO(OS) 321/2017, and the Supreme Court declined Special Leave to Appeal by order dated 08.10.2018 in SLP (C) No. 26958/2018.

Mr. Vadlamani Seshagiri, learned counsel for the official liquidator of the petitioner, states that the awarded amount has already been withdrawn by the company in liquidation and he submits that the challenge to the award dated 17.03.2015 does not survive for consideration 4.

The petition is disposed of as not pressed, in terms of the statement recorded above.
