The present petition has been filed by the petitioner praying, inter alia, for production of his wife, Roma Devi, who is stated to have gone missing from their home on 19.12.2018. When the petitioner came back from work at 6 p.m., he was so informed by his two minor children, aged 7 years and 4 years respectively. The petitioner has raised a finger of suspicion on the respondent No.4, a colleague working at the same place where he is employed. The petitioner has averred that on 30.12.2018, he had received a ransom call from some unknown number demanding a sum of Rs.3 lacs for releasing his wife. He claims to have been receiving numerous calls from other numbers allegedly at the behest of the respondent No.4. Aggrieved thereby, the petitioner had approached P.S. Saket with his grievance, but no W.P.(CRL) 548/2019

FIR has been registered so far.

On the first call, none was present on behalf of the petitioner and nor was the petitioner present. As a result, the matter was passed over. 3.

On the second call at 12.15 pm, again, none is present for the petitioner. Learned Standing Counsel (Crl.) states that the Naib Court has also telephonically tried to reach out to the petitioner but he is not picking up the phone. He has handed over a Status Report and states that Ms. Roma Devi is present in Court. He explains that on 18.02.2019, Ms. Roma Devi along with respondent No.4 had visited Police Station Saket and stated that her husband was harassing her and therefore, she had left her matrimonial home of her own free will, and shifted with the respondent No.4. She had also stated that she proposes to file a divorce petition against the petitioner. The statement made by Ms. Roma Devi was recorded and DD No.38A dated 18.02.2019, was filed. Learned Standing Counsel (Crl.) states that the aforesaid facts are in the knowledge of the petitioner as he had visited the Police Station where his wife was also present but she had refused to go back with him and had left the Police Station with the respondent No.4. 4.

Ms. Roma Devi is present in Court. We have spoken to her. She is firm in her decision that she does not wish to return to her matrimonial home.

It appears that the petitioner does not wish to pursue the present petition, as he is aware of the view expressed by his wife. The Status Report handed over by learned Standing Counsel (Crl.) for the State is taken on record.

The petition is dismissed in default.
